[asianamericanromance] China Marriage - Spouse Visa or Fiancee Visa



After I started my paperwork with USCIS my spouse arrived in the
U.S. 8 months later on a K-3 Visa. The K-3 Visa is issued with a
2-year expiration date. USCIS can issue a 10-year Permanent
Resident -Green Card- (after) you have been married for 2 years.
 
Since we were already married before my wife received her K-3 Visa
this allowed her to apply for the 10-year green card just 11 months
later after arriving in the U.S. (No need to apply for a 2 year
Conditional. Less time, less money)

In 2009 the wait time for a K1 or K3 interview to enter the U.S.
has increased 12 to 14 months. This means that your spouse could be
approved for a 10 year PRC in just 7 to 9 months after arriving in
the U.S. K3 Total time to 10 year Permanent Resident (Green Card)-
24 months
 
For my friends whose loved ones entered the U.S. on the K-1 Visa
with a 6-month expiration date and then married within 90 days
after arriving, this process took much longer and cost more money.
 
You see, a Conditional Permanent Resident card will be issued after
the marriage with a 2-year expiration date.  Ninety days prior to
that expiration (2 years after your marriage) the foreign spouse
can then apply for Adjustment of Status and  the 10-year Permanent
Resident (Green Card).

Lets take a closer look at the K1 in 2009.

12 to 14 months for an interview to enter the U.S.
90 days to get married after entering.
2 year Conditional Permanent Resident Card issues after marriage.
Filing for Adjustment of Status (90 days) before expiration.
10 year Green Card issued.

K1 Total time to 10 year Permanent Resident (Green Card)- 39 months
 
This has made a huge difference in cost for some I have interviewed
who hired an attorney and charged monthly for an open case or
tickling the files.  Some will charge a flat rate.
